    Acceptance and Modification of Terms

1.1 By using our website or proceeding with any purchase or adoption process, the Buyer acknowledges and agrees to be legally bound by these Terms and Conditions in full, without exception.

1.2 The Company reserves the right to update, modify, or replace any part of these Terms at its sole discretion. Any changes to the Terms will become effective upon posting on the Website. Continued use of the Website or services following any modifications constitutes the Buyer’s full acceptance of the updated Terms.

1.3 Section headings are provided for convenience and reference only and shall not affect the meaning, interpretation, or enforceability of any provisions contained herein.

1.4 The Buyer affirms that they have read, fully understood, and accepted these Terms prior to submitting payment or completing any reservation. Failure by the Buyer to review these Terms does not exempt them from legal responsibility or enforceability under this agreement.

1.5 If the Buyer does not agree to these Terms, they must not use the Website, proceed with any purchase, or engage in the adoption process.

2. License to Use Website

2.1 Kitten Heaven grants the Buyer a limited, personal, revocable, non-exclusive, non-transferable license to access and use our website strictly for personal, non-commercial purposes related to the evaluation and purchase of kittens or related services.

2.2 This license does not permit resale, distribution, reproduction, duplication, or any commercial exploitation of the Website content, in whole or in part, without the prior written consent of Kitten Heaven.

2.3 Use of the Website is strictly prohibited in any jurisdiction where such use would violate applicable laws or regulations.

2.4 Kitten Heaven reserves the right to revoke or restrict access to the Website at any time and for any reason, without notice, particularly in cases of misuse or violation of these Terms and Conditions.

3. Eligibility

3.1 The use of our website and participation in any purchase or adoption process is strictly limited to individuals who are eighteen (18) years of age or older and who possess the legal capacity to enter into binding contracts under applicable law.

3.2 By using the Website or initiating an adoption, the Buyer represents and warrants that they meet the age and legal requirements stated herein.

3.3 Kitten Heaven reserves the right to refuse service, terminate accounts, or cancel transactions if it is determined that the Buyer does not meet these eligibility requirements.

4. Monitoring and Accuracy

4.1 Kitten Heaven strives to provide accurate, up-to-date information on our website but makes no warranties or guarantees regarding the accuracy, completeness, or reliability of any content, pricing, availability, or descriptions presented on the Website.

4.2 Information and offerings on the Website may change at any time without prior notice, and Kitten Heaven reserves the right to update, modify, or remove content as needed.

4.3 The Buyer is solely responsible for monitoring updates to the Website, including changes to pricing, availability, Terms and Conditions, and product or service details.

4.4 Kitten Heaven shall not be held liable for any damages or losses arising from reliance on outdated, incomplete, or inaccurate information found on the Website.

5. Third-Party Services

5.1 Our website may contain links to third-party websites, services, platforms, or tools that are not owned, operated, or controlled by Kitten Heaven.

5.2 Kitten Heaven makes no representations or warranties regarding the accuracy, availability, reliability, or quality of such third-party services and assumes no liability for any loss or damage that may arise from the Buyer’s use of or reliance upon them.

5.3 The use of third-party tools, services, or integrations (including but not limited to payment processors, couriers, or communication platforms) is entirely at the Buyer’s own risk and is provided strictly on an “as is” and “as available” basis without warranties of any kind, express or implied.

5.4 Kitten Heaven does not guarantee the performance, security, or functionality of any third-party service and is not responsible for any delays, failures, or errors caused by third parties.

5.5 The Buyer is encouraged to review the terms and privacy policies of any third-party service providers prior to use.

   6. Reservation, Payment & Cancellation Policy

6.1 Reservation Fee
A non-refundable reservation fee is required to initiate the adoption process and secure the Buyer’s chosen kitten. The reservation fee guarantees the Buyer’s place in the adoption queue and ensures the kitten is held exclusively for the Buyer.

6.2 Purpose of Reservation Fee
The reservation fee covers:

    Administrative processing
    Veterinary care coordination
    Breeder communications
    Other necessary preparations associated with the adoption

6.3 Order Limitations
Kitten Heaven reserves the right to limit or decline orders at its sole discretion. Limitations may be based on:

    Customer profile
    Shipping address
    Payment method

6.4 Payment Requirements
The Buyer must provide accurate, current, and complete payment and account information at the time of transaction.
All payments are securely processed through trusted third-party processors.

6.5 Unauthorized Chargebacks
Any chargeback or payment dispute initiated without legitimate basis will be considered a breach of this agreement and may result in legal action to recover all losses, including penalties, processing fees, and attorney’s fees.
In such cases, Kitten Heaven reserves the right to:

    Retain the reservation fee in full
    Recover legal fees, chargeback penalties, and administrative costs

6.6 Pricing and Taxes
All listed fees exclude applicable taxes and are subject to change without prior notice.

6.7 Add-Ons
All optional add-on purchases are final and non-refundable once purchased. These may include (but are not limited to):

    Delivery upgrades
    Protection plans
    Extended health guarantees

See Section 50.5 for policies on transferability and non-refundable status of add-ons in unfit-for-purchase situations.

6.8 Reservation Transfer Policy

Each reservation is specific to the kitten selected at the time of purchase and is non-transferable.
Kitten Heaven works with multiple breeders, and each reservation is directly linked to a specific kitten and breeder.
Therefore, reservations cannot be transferred to a different kitten or breeder unless such a change is expressly offered by Kitten Heaven due to:

    Illness
    Developmental concerns
    Breeder withdrawal

If the Buyer independently chooses to change their reserved kitten for any reason not initiated by Kitten Heaven, the original reservation fee will be forfeited in full, and a new reservation and payment must be made to begin a new adoption.

6.9 Cancellation Policy

6.9.1 Buyer-Initiated Cancellations
The reservation fee remains strictly non-refundable under all circumstances, except in the following limited cases:

    If delivery is delayed beyond 90 days from the estimated timeline due to Company or breeder-related issues
    If the kitten is deemed unfit for purchase by a licensed veterinarian due to a hereditary or congenital condition diagnosed prior to transfer

In all other situations, including cancellations due to personal reasons, the reservation fee is retained in full by Kitten Heaven. Administrative fees apply in addition to the forfeiture of the reservation fee.

6.9.2 Administrative Fees
An additional administrative fee will apply based on the progress of the adoption process:

    $100 Administrative Fee for early-stage cancellations (prior to veterinary exam and breeder confirmation)
    $550 Administrative Fee for advanced-stage cancellations (after veterinary clearance, breeder confirmation, or start of travel coordination)

These fees reflect the time, coordination, and veterinary services already invested by Kitten Heaven on behalf of the Buyer.

6.10 Customer Assurance
This policy ensures every adoption is handled with care, professionalism, and timely preparation — while respecting the time and resources of all involved parties.


   7. Health Guarantee

7.1 Overview
Kitten Heaven provides a one-year genetic health guarantee for life-threatening or debilitating hereditary and congenital conditions that significantly impact the kitten's quality of life.

7.2 Covered Conditions
The following conditions are covered under the genetic health guarantee:

    Hypertrophic Cardiomyopathy (HCM)
    Polycystic Kidney Disease (PKD)
    Severe organ defects
    Serious congenital disorders

Severe Dysplasia (hip or elbow):

    Must be diagnosed within twelve (12) months of adoption
    Diagnosis must be confirmed by a licensed veterinarian using radiographs
    The condition must be hereditary or congenital, not caused by injury or environmental factors
    Eligible for 100% credit or refund (minus non-refundable fees) based on claim timeline

Severe Patellar Luxation (Grade III or IV):

    Must be diagnosed within twelve (12) months of adoption
    Must be confirmed as requiring surgical correction by a licensed veterinarian
    Especially relevant for predisposed breeds such as Maine Coons
    Eligible for credit or refund under the same terms as dysplasia

7.3 Excluded Conditions (Not Covered)
The following conditions are excluded from the genetic health guarantee:

    Heart murmurs, unless confirmed as congenital/hereditary via echocardiogram by a licensed vet
    Respiratory conditions (URI, FHV, Calicivirus)
    Feline Infectious Peritonitis (FIP)
    Parasites (Giardia, Coccidia, Tritrichomonas)
    Fleas, ear mites, worms, or general deworming needs
    Bacterial infections (Mycoplasma, Chlamydia)
    Cosmetic/non-life-threatening issues (hernias, mild murmurs, minor joint laxity)
    Stress-induced symptoms from travel or rehoming
    Rectal prolapse, inguinal hernias, intestinal intussusception
    Any condition not deemed congenital/hereditary/life-altering by a licensed vet
    Stomatitis, gingivitis (any severity)
    Nasolacrimal duct obstruction (blocked tear ducts)
    Polyps (including nasopharyngeal or non-hereditary growths)

7.4 Documentation Requirements

    The health guarantee applies only to the original Buyer and is non-transferable
    Claims must be submitted within 14 days of diagnosis
    Full veterinary documentation is required (including imaging if applicable)
    Purebred LLC reserves the right to request a second opinion from an independent veterinarian

7.5 Remedies for Valid Genetic Claims (Within First 12 Months)

    Months 0–6: 100% of base purchase price as credit or refund (minus non-refundable fees)
    Months 7–12: 50% of base purchase price as credit or refund (minus non-refundable fees)
    Non-refundable fees include: reservation fee, delivery fee, administrative fee, cost of guarantee, and any purchased add-ons
    Approved claims processed within 14 business days of receiving full documentation
    If Buyer does not select a remedy within 7 days, a credit will be automatically applied

7.6 Optional 3-Year Extended Guarantee

    Available for an additional fee
    Applies from months 13–36
    Covers death due to genetic conditions only
    Treatment costs are not covered
    Requires licensed veterinarian’s death certificate confirming a genetic cause

Remedies under Extended Guarantee:

    Credit: 100% of base price toward a replacement kitten
    Refund: 100% of base price minus non-refundable fees

7.7 Additional Terms

    Emotional distress, veterinary expenses, or consequential costs are not reimbursed
    Failure to provide full documentation voids the guarantee
    No guarantees are made regarding adult size, coat, temperament, allergy response, or future health beyond these terms.

      8. Veterinary Requirements

8.1 Initial Examination
The Buyer must take the kitten to a licensed veterinarian within 48 business hours of receiving the kitten for a full wellness examination and stool analysis.

8.2 Parasite Disclosure
The Buyer acknowledges that internal parasites — including but not limited to Giardia, Coccidia, and Tritrichomonas — are common in kittens and are not covered under the health guarantee. The presence of such parasites does not constitute grounds for refund, credit, or claim.

8.3 Vaccination Timing
To avoid over-vaccination and stress-related complications, the Buyer agrees not to administer any vaccinations within the first 10 days following adoption unless specifically recommended by a licensed veterinarian.

8.4 Ongoing Veterinary Care
The Buyer is responsible for maintaining regular veterinary care for the kitten, including but not limited to:

    Routine wellness check-ups
    Core and booster vaccinations
    Deworming
    Any preventive treatments recommended by their veterinarian

8.5 Documentation Requirement
Failure to provide complete medical records — including the initial veterinary examination and ongoing care documentation — will void all health guarantees provided by Kitten Heaven.

    9. FCoV / FIP Disclosure

9.1 General Acknowledgment
The Buyer acknowledges that Feline Coronavirus (FCoV) is a common virus in cats and may, in rare cases, mutate into Feline Infectious Peritonitis (FIP), which is typically fatal.
FCoV and FIP are not covered under the standard health guarantee provided by Kitten Heaven.

9.2 Optional FIP Protection Plan
If the Buyer has purchased the optional FIP Protection Plan at the time of reservation or prior to the kitten’s delivery, the Buyer is eligible to receive a refund of the kitten’s base adoption fee if the kitten is diagnosed with FIP and passes away within three (3) years from the date of adoption.

9.3 Coverage Terms

    The FIP Protection Plan applies only to the refund of the base adoption fee
    It does not cover veterinary expenses, treatments, diagnostics, or any associated costs.

9.4 Required Documentation for Claims
To be eligible for reimbursement under the FIP Protection Plan, the Buyer must submit:

    A licensed veterinarian’s written diagnosis confirming FIP
    Veterinary documentation confirming FIP as the cause of death
    All required documentation within 30 calendar days of the date of the kitten’s passing

9.5 No Coverage Without Plan
Without the purchase of the FIP Protection Plan, no refunds, credits, or reimbursements are available for outcomes related to FCoV or FIP.

       10. Delivery and Shipping

10.1 Delivery, Shipping, and Customer Pickup Obligations

10.1. Delivery Timeframe
Shipping or delivery will occur within 2 to 14 calendar days following final veterinary clearance confirming the kitten is healthy and ready for travel. Kitten Heaven will notify the Buyer once the veterinarian has approved the kitten for release.

Delivery timelines may extend beyond 14 days only in the event of:

    Recovery needs
    Health monitoring
    Weather delays
    Transportation logistics

Kitten Heaven will keep the Buyer informed of any updates to the delivery timeline. Delays for these reasons are not grounds for cancellation or refund.

10.1.2 Delays: Delays due to health, recovery time, weather conditions, or logistics are not grounds for cancellation or refund. Kitten Heaven will keep the Buyer informed of any changes to the delivery timeline.

10.1.3 Self-Pickup: Self-pickup is permitted by prior arrangement. If the Buyer fails to appear for the scheduled pickup without providing prior notice, a boarding fee of $25 per day will be applied to cover the cost of care and accommodation.

10.2 Customer Response Timeline

10.2.1 Once the kitten is declared ready for delivery or pickup and the Buyer is notified, the Buyer must respond and arrange delivery or pickup within 7 calendar days of notification.

10.2.2 Failure to respond within 7 days results in the application of the $25 daily boarding fee, retroactive to the initial notification date.

10.2.3 If the Buyer fails to complete pickup or delivery within 14 calendar days of the kitten being declared ready, Kitten Heaven reserves the right to consider the reservation abandoned, and the Buyer will forfeit all fees paid, including the reservation fee, administrative fees, and adoption fee. In cases of abandonment, Kitten Heaven may rehome the kitten without further obligation to the original Buyer.

10.3 Delivery Refusal Policy If the Buyer refuses or fails to accept delivery of the kitten at the scheduled time and location — without prior written notice or valid cause — Kitten Heaven will consider the delivery attempt fulfilled. The Buyer will be held fully responsible for all costs associated with the missed delivery, including transportation, courier time, and boarding fees. In such cases, Kitten Heaven reserves the right to: Apply a $25/day boarding fee starting from the scheduled delivery date Require the Buyer to pay a new delivery fee before rescheduling Consider the reservation abandoned if delivery is not completed within 14 calendar days, in which case all paid fees will be forfeited, and the kitten may be rehomed without further obligation to the Buyer This policy is in place to ensure the health, safety, and timely placement of every kitten.

10.4 Appearance, Origin & Buyer Preference Disclaimer The Buyer understands that minor differences in appearance — including coat length, pattern, size, or features — may occur due to natural development, lighting, or photography conditions. These variations do not constitute grounds for refusal of delivery, dispute, or refund. Additionally, once a reservation is made, preferences related to breeder origin, breeder location, or other non-health-related characteristics are not considered valid grounds for cancellation, refund, or refusal to complete the adoption. Any refusal to accept delivery based on personal preference, breed variations, or appearance not affecting the kitten’s health or eligibility will be treated as a delivery refusal under these Terms and subject to forfeiture of all fees paid.

10.5 Undeliverable After 90 Days If Kitten Heaven is unable to complete delivery of the kitten within 90 calendar days from the originally scheduled delivery date due to circumstances beyond the Company's control, the Buyer will be offered: A full refund of all amounts paid, including the reservation fee, administrative fees, adoption fee, and any purchased add-ons. Alternatively, at the Buyer’s discretion, a credit toward the selection of another kitten.

      11. Customer Responsibilities

11.1 Health and Wellness Acknowledgment
The Buyer understands that kittens are live animals and may experience minor health fluctuations, especially during times of transition such as travel or rehoming.

11.2 Temperament Disclaimer
Temperament is not guaranteed and may be influenced by genetics, environment, handling, and training.

11.3 Ongoing Care Commitment
The Buyer agrees to provide appropriate care for the kitten, including:

    Proper nutrition and feeding
    Adequate physical and emotional stimulation
    Routine and emergency veterinary care

11.4 Financial Responsibility
All veterinary care and associated costs are the sole responsibility of the Buyer from the time of delivery or pickup onward.

11.5 Assumption of Risk
The Buyer assumes all risks inherent in pet ownership, including but not limited to injury, illness, allergic reactions, behavioral challenges, and long-term medical needs.

12. Death or Severe Abnormality

12.1 General Policy
In the event of sudden death within the first 14 days after adoption, due to a non-genetic medical condition (excluding FIP), Kitten Heaven may, at its discretion, offer a partial refund, store credit, or replacement kitten as a goodwill gesture — provided the Buyer submits full veterinary documentation confirming the cause of death.

12.2  Required Documentation
To qualify for any remedy related to sudden death or diagnosis of a severe, life-threatening abnormality, the Buyer must submit the following:

    A written report from a licensed veterinarian clearly stating the diagnosis and probable cause of death
    Any relevant test results, imaging, or necropsy findings, if applicable

This documentation applies whether the Buyer is requesting a refund, store credit, or replacement kitten.

12.3 Exclusions
Claims are not eligible for remedy in cases involving Buyer negligence, including but not limited to:

    Accidental poisoning
    Trauma or injury
    Failure to follow veterinary guidance

Kitten Heaven reserves the right to deny claims if evidence suggests the kitten’s passing was preventable or due to improper care.

12.4 Severe Abnormalities
In the event of diagnosis of a severe, life-threatening abnormality, or sudden death:

    The Buyer must retain possession of the kitten and notify Kitten Heaven immediately
    If no visible cause of death is determined, a gross and micro necropsy performed by a licensed veterinarian or pathology lab is required
    The necropsy report must be submitted within 14 business days of the kitten’s passing unless an extension is approved in writing
    The report must clearly confirm a congenital or genetic cause of death to qualify for a remedy

12.5 Euthanasia Requirements
If euthanasia is performed, claims must include documentation from a licensed veterinarian stating the condition was non-treatable and life-threatening.
Home euthanasia without proper medical documentation will void this guarantee.

12.6 Remedies
For verified genetic-related deaths or abnormalities:

    Remedies follow the same refund and credit structure described under the Genetic Health Guarantee
    Remedies may include a full refund, partial refund, store credit, or replacement kitten, depending on the cause and timing

If a replacement kitten is offered and declined by the Buyer, Kitten Heaven has no further obligation to issue additional remedies.

In rare, non-genetic cases verified within the first 14 days, Kitten Heaven may, at its sole discretion, offer a refund, partial refund, store credit, or replacement kitten as a goodwill gesture. If any remedy is declined, Kitten Heaven assumes no further responsibility.

12.7 Additional Terms

    Emotional distress, veterinary expenses, or consequential costs are not reimbursed
    Failure to provide complete documentation voids the guarantee
    Buyer acknowledges that no guarantees are made regarding adult size, coat, temperament, allergy response, or future health beyond the written terms of this agreement.

      13. SMS Communication Policy

13.1 Opt-In Methods
Opt-in for SMS communication is available.

 

13.2 Consent and Agreement


13.3 Message Content
SMS messages may include, but are not limited to:

    Promotions and special offers
    Adoption updates
    Reminders or alerts

13.4 Frequency and Carrier Terms

    Message frequency may vary based on user activity, typically 1–5 times per week
    Standard message and data rates may apply based on your mobile carrier plan

13.5 Unsubscribe and Help Options

    Reply "STOP" to unsubscribe from further SMS communications
    Reply "HELP" for assistance or contact us.

13.6 Limitations of Liability
Kitten Heaven is not liable for any SMS delivery delays, technical issues, or interruptions caused by carriers or third-party platforms.

13.7 Privacy and Data Use
Your SMS data and phone number will never be shared, sold, or used for unrelated purposes without your explicit consent.

13.8 Acceptance of Policy
By agreeing to these Terms and Conditions, the Buyer also accepts the SMS Communication Policy.

       14. Rehoming and Right of First Refusal

14.1 If the Buyer is no longer able to keep the kitten for any reason, the Seller retains the right of first refusal and may choose to repurchase the kitten for $1, provided written notice is received within 15 days of the Buyer’s intent to rehome.

14.2 If the Seller exercises this right, the Buyer agrees to return the kitten at their own expense.

14.3 If the Seller declines to reclaim the kitten, the Buyer must provide the full name, address, and contact information of the intended new owner, along with details of the new living arrangements. This is to ensure the kitten’s continued welfare.

14.4 The Seller is under no obligation to refund the purchase price or any associated costs, including but not limited to veterinary care, transportation, or supplies.

    Limitation of Liability

15.1 Website and kittens are provided “as-is” with no implied warranties beyond those stated.

15.2 The Company is not liable for indirect, incidental, consequential, or emotional damages.

15.3 In jurisdictions where such limitations are disallowed, liability is capped to the extent allowed by law.

    Indemnification

16.1 The Buyer agrees to indemnify, defend, and hold harmless Kitten Heaven, its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, demands, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

16.1.1 The Buyer’s violation of these Terms and Conditions,

16.1.2 Any misuse of the Website or its content,

16.1.3 Any negligence or misconduct related to the care, ownership, or rehoming of the adopted kitten, or

16.1.4 Any third-party claims resulting from the Buyer’s actions or omissions.

16.2 This obligation shall survive the termination of this Agreement and the completion of the adoption process.

17. Termination

17.1 These Terms shall remain in full force and effect unless and until terminated by either party.

17.2 Kitten Heaven reserves the right to suspend or terminate access to the Website or adoption services at its sole discretion, without prior notice, in the event of any breach of these Terms, suspected misuse, or conduct deemed harmful to the Company, its partners, or its animals.

17.3 Termination of this Agreement shall not affect any rights or obligations that have accrued prior to the termination date, including but not limited to payment responsibilities, confidentiality provisions, and indemnity obligations.

      18. Entire Agreement

18.1 These Terms and Conditions constitute the entire agreement between the parties and supersede all prior discussions, communications, representations, agreements, or understandings, whether written or oral, relating to the subject matter herein.

18.2 No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Kitten Heaven. The failure to enforce any right or provision shall not be deemed a waiver of future enforcement of that right or any other provision.

18.3 Any ambiguity in these Terms shall not be construed against the drafting party, and both parties acknowledge that they have had the opportunity to review and consult legal counsel before agreeing to these Terms.

19. Force Majeure

19.1 Kitten Heaven shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to: natural disasters, pandemics, epidemics, labor strikes, transportation delays or disruptions, governmental actions, acts of war or terrorism, power outages, or failures of communication networks or third-party service providers.

19.2 Such events shall not constitute a breach of these Terms, and any resulting delays shall not entitle the Buyer to refunds, credits, or compensation, unless otherwise expressly stated.

19.3 In the event of such circumstances, Kitten Heaven will make reasonable efforts to notify affected parties and resume performance as soon as reasonably possible.

20. No Warranties Disclaimer

20.1 Kitten Heaven makes no guarantees or warranties regarding the kitten’s future health, behavior, size, coat quality, fertility, or temperament, beyond those explicitly stated in the Health Guarantee or other written agreements.

20.2 While every effort is made to provide accurate breed expectations and place healthy, well-socialized kittens, individual development may vary due to genetics, environment, and care provided by the Buyer.

21. Assumption of Risk

21.1 The Buyer acknowledges and accepts that adopting a live animal involves inherent unpredictability, and that no living being can be guaranteed to develop in a specific way.

21.2 By completing the adoption, the Buyer assumes all risks related to the kitten’s health, behavior, temperament, compatibility with other pets or family members, and overall adjustment to the new home.

21.3 While Kitten Heaven and its breeders make every reasonable effort to ensure proper care, socialization, and health prior to adoption, the long-term outcome depends on many variables beyond the Company’s control.

      22. Claims and Limitations

22.1 Genetic Health Guarantee
For health issues that fall under the scope of the Genetic Health Guarantee, the Buyer must initiate a claim within twelve (12) months of the kitten’s delivery date. A licensed veterinarian’s written diagnosis confirming a congenital or hereditary condition must be submitted in support of the claim. Claims filed after this 12-month period will not be eligible for consideration.

22.2 Death Within 14 Days (Non-Genetic Cause)
If the kitten passes away within fourteen (14) calendar days of delivery due to a non-genetic medical issue, the Buyer must notify Kitten Heaven within that time-frame and provide written documentation from a licensed veterinarian confirming the cause of death. In such cases, Kitten Heaven will conduct a case-by-case review and, at its sole discretion, may offer a partial refund, store credit, or replacement kitten as a goodwill gesture. This applies only if the death was not caused by preventable factors such as injury, neglect, or poisoning.

22.3 Time-Barred Claims
Any claims submitted outside the applicable timeframes stated above shall be considered permanently barred, and Kitten Heaven shall have no further liability or obligation.

     23. Time Limit for Disputes

23.1 The Buyer must initiate any claim or dispute related to the adoption — including but not limited to requests for refunds, replacements, complaints about service, or concerns regarding the kitten’s condition — within six (6) months from the date of delivery.

23.2 Any claim submitted after this six-month period shall be permanently barred, and Kitten Heaven shall have no obligation to investigate, respond to, or provide resolution for claims filed beyond this timeframe.

    24. Right to Refuse or Cancel Adoption

24.1 Purebred LLC reserves the right to refuse or cancel any adoption at its sole discretion, including but not limited to cases where:

24.1.1 The Buyer fails to meet the company’s suitability criteria

24.1.2 The Buyer provides false or incomplete information

24.1.3 The Buyer is unresponsive or fails to complete arrangements within required timeframes

24.1.4 Concerns arise regarding the kitten’s welfare, including indications of potential neglect, harm, or improper care environment

24.1.5 The Buyer violates any terms outlined in this agreement

24.2 If an adoption is canceled by the Company for any reason not related to buyer misconduct, a full or partial refund may be issued at the Company’s discretion.

24.3 If cancellation results from buyer misconduct, violation of these Terms, or abandonment — including but not limited to failure to complete delivery or pickup within the specified timeframe, or if the Buyer is unreachable for more than 14 days after the kitten is declared ready — then all fees paid (including the reservation fee, administrative fees, delivery fees, add-ons, and adoption fee) will be permanently forfeited and will not be refunded under any circumstance.

24.4 In such cases, Kitten Heaven will be under no further obligation to the Buyer, including but not limited to rebooking, rescheduling, or offering replacement kittens.

24.5 Any attempt to initiate a chargeback or payment dispute under these conditions will be considered fraudulent, and Kitten Heaven reserves the right to pursue legal action to recover all associated losses, including chargeback penalties, legal costs, and administrative fees.

25. Burden of Proof for Guarantee Claims

25.1 All health-related claims made under this guarantee must be supported by the following:

25.1.1 Full veterinary medical records, including the kitten’s exam history and treatment notes

25.1.2 Relevant diagnostic test results (e.g., X-rays, ultrasound, lab work)

25.1.3 A signed letter or report from a licensed veterinarian confirming that the condition is of genetic or congenital origin

25.2 Failure to provide complete and timely documentation will result in the denial of the claim and void the guarantee.

26. Jurisdiction and Venue

26.1 All disputes arising out of or relating to this agreement shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

26.2 Venue for any legal action shall be exclusively within the state or federal courts located in the State of Delaware.

26.3 By entering into this agreement, the Buyer waives any right to challenge or change the venue and agrees to submit to the jurisdiction of Delaware courts.

27. No Third-Party Reliance

27.1 Only written statements, agreements, or guarantees issued directly by Kitten Heaven shall be considered legally binding.

27.2 Any verbal statements, third-party opinions, or information shared through social media, forums, or unofficial channels are non-binding and shall not be relied upon as part of this agreement.

28. Rehoming Responsibility

28.1 If the Buyer is no longer able or willing to care for the kitten at any point after adoption, the Buyer assumes full responsibility for arranging safe and appropriate rehoming.

28.2 Kitten Heaven does not provide post-sale rehoming or placement services, and is not obligated to take the kitten back or assist in rehoming efforts.

29. Customer Acknowledgment

29.1 The Buyer understands and accepts that live animals may experience minor health fluctuations, especially during transition periods such as travel or rehoming.

29.2 The Buyer agrees not to dispute or reverse payment for conditions that are non-genetic, treatable, or temporary.

29.3 Refunds are only granted for conditions that meet the requirements of the Genetic Health Guarantee as explicitly outlined in these Terms.

29.4 The reservation fee is strictly non-refundable under all circumstances, including but not limited to buyer cancellation, change of mind, or unexpected scheduling conflicts.

29.5 All kittens are examined and cleared by licensed veterinarians prior to release and adoption.

    30. Customer Confirmation

30.1 By submitting payment and completing a reservation, the customer confirms:

30.1.1 They have read and agree to these Terms.

30.1.2 They understand that minor conditions, delays, or appearance changes are not grounds for refunds.

30.1.3 They acknowledge the non-refundable nature of the reservation fee.

30.1.4 They accept the animal’s veterinary-cleared condition.

30.1.5 They will not dispute or chargeback payment outside the agreed terms.

      31. Exclusive Remedy Clause

31.1 The remedies outlined in this agreement — including refund, store credit, or replacement kitten — shall constitute the exclusive remedies available to the Buyer.

31.2 No other remedies shall apply, including but not limited to consequential, incidental, emotional, or indirect damages, unless otherwise required by law.

32. Limitation on Damages

32.1 In no event shall the Company’s total liability exceed the amount actually paid by the customer for the kitten.

32.2 Emotional distress, sentimental loss, loss of companionship, or loss of enjoyment are not compensable under any circumstance.

33. Ready-For-Travel Kittens Notice

33.1 A “Ready-for-Travel” label indicates that the kitten has been medically cleared for travel, is fully weaned, and, where applicable, is either spayed/neutered or ready and eligible for the procedure in accordance with the terms of the sale.

33.2 However, final release may still be postponed at the discretion of a licensed veterinarian, or due to weather conditions, travel logistics, or any health-related concerns to ensure the safety and wellbeing of the kitten.

34. Age Disclosure and Development

34.1 Kittens are adopted at a healthy and appropriate age, typically 16 weeks depending on breed and individual development.

34.2 Buyer understands that development and readiness may vary based on breed-specific maturity and veterinary health requirements.

35. Liquidated Damages for Contract Violation

35.1 Buyer agrees that any public defamation, false online reviews, or social media disparagement in violation of these Terms may cause irreparable harm.

35.2 In such cases, the Company may seek liquidated damages in the amount of $2,500 per violation, in addition to legal fees.

     36. Sales and Guarantees – Additional Conditions

36.1 All sales are final unless otherwise provided in these Terms.

36.2 Deposits to reserve kittens are non-refundable under any circumstances, unless the kitten is found to have a verified medical condition that makes it unfit for sale as defined in this agreement.

36.3 The Buyer agrees to provide a safe, responsible, and suitable home environment for the kitten.

36.4 The Buyer must take the kitten to a licensed veterinarian for a wellness exam within 72 hours of pickup or delivery.

36.5 A stool analysis must be performed during the first veterinary visit, at the Buyer’s expense.

36.6 Parasites such as giardia, coccidia, and similar organisms are considered common in kittens and not covered under the genetic or health guarantee.

36.7 These issues are considered maintenance conditions and do not qualify for a refund or replacement.

       37.  FIP & FCOV Customer acknowledgement

37.1 The Buyer understands that Feline Coronavirus (FCoV) is common in cats and may, in rare cases, mutate into Feline Infectious Peritonitis (FIP).

37.2 FIP is typically fatal and is not covered under the standard health guarantee unless the Buyer has purchased additional FIP coverage.

37.3 The FIP vaccine is not proven effective and is not recommended by leading feline veterinary panels.

37.4 The Buyer agrees not to seek a refund, credit, or dispute for FCoV or FIP-related conditions unless specifically covered under an optional protection plan.

     38. Veterinary examination and unfit condition

38.1 The Buyer must take the kitten to a licensed veterinarian for a full wellness exam within 72 hours of receiving the kitten.

38.2If the kitten is deemed unfit for purchase due to a congenital or hereditary defect, the Buyer may return the kitten. Upon confirmation and review, Kitten Heaven will issue a full refund of the adoption fee (including the reservation fee), or offer a store credit or replacement kitten — at the Buyer’s discretion. Any purchased add-ons and delivery fees are non-refundable. Please refer to Section 50 for policies regarding the transferability of add-ons in the event a replacement kitten is issued.

38.3 The Buyer must notify Kitten Heaven within 2 business days of such a determination.

38.4 All veterinary documentation — including certificates, test results, and medical notes — must exclude any language requesting reimbursement of costs, unless such reimbursement is explicitly required by applicable law.

     39.  Emergency veterinary visits

39.1 The Buyer is responsible for the full cost of all emergency veterinary visits, unless otherwise required by law.

39.2 Kitten Heaven strongly recommends that the Buyer contact the Company prior to any emergency veterinary visit, whenever possible, to help avoid unnecessary or non-covered costs.

39.3 Kitten Heaven discourages visits to corporate veterinary chains, such as Banfield and VCA, due to a history of over-treatment, inflated billing, and inconsistent care that may not align with the Company’s veterinary standards.

     40. Vaccination policy

40.1 The kitten will be up to date on all core vaccinations at the time of delivery.

40.2 The Buyer must not administer any additional vaccinations within the first 10 days following adoption, unless medically necessary and approved by a licensed veterinarian.

40.3 Any over-vaccination or unnecessary vaccinations during this period will void the health guarantee.

    41. Hip & patella clause

41.1 The Buyer understands that overfeeding or excessive physical activity during early development can worsen underlying congenital joint conditions, including hip dysplasia and patellar luxation.

41.2 The Buyer agrees to moderate both diet and exercise during the kitten’s early growth phase to support healthy joint development and reduce the risk of orthopedic issues.

   42. Customer commitments & health maintenance

42.1 The Buyer agrees to maintain ongoing veterinary and wellness care, including but not limited to:
42.1.1 Annual veterinary check-ups
42.1.2 A balanced and species-appropriate diet
42.1.3 Nutritional supplements if recommended by a veterinarian
42.1.4 Timely administration of core and booster vaccinations

42.2 Failure to provide documentation of appropriate medical care, including wellness visits and vaccination records, will void all health guarantees.

42.3 Spaying or neutering is strongly recommended, unless breeding rights have been specifically granted in writing.

    43. Breeding policy

43.1 All kittens are sold strictly as pets only and are not to be used for breeding unless otherwise agreed in writing.

43.2 Commercial breeding is strictly prohibited unless the Buyer has formally purchased breeding rights through a separate, signed agreement with Kitten Heaven.

    44. Temperament disclosure

44.1 Kitten Heaven does not guarantee temperament, personality traits, or behavioral outcomes.

44.2 The Buyer understands that a kitten’s behavior may evolve over time and can be influenced by factors such as environment, socialization, handling, and training.

    45. Necropsy requirement in event of death

45.1 In the event of sudden death or the diagnosis of a severe, life-threatening abnormality, the Buyer must retain possession of the kitten unless otherwise directed by a legal authority.

45.2 The Buyer must notify Kitten Heaven immediately upon the kitten’s passing or diagnosis.

45.3 If no clear external cause of death is identified, a gross and micro necropsy must be performed by a licensed veterinary pathologist at the Buyer’s expense.

45.4 The health guarantee will be voided if a necropsy report is not provided, or if the findings are inconclusive or do not clearly indicate a genetic or congenital cause of death.

45.5 The necropsy report must be submitted to Kitten Heaven within 14 business days of the kitten’s passing, unless an extension is requested and approved in writing.

45.6 Claims involving euthanasia must include documentation from a licensed veterinarian stating that the condition was non-treatable and life-threatening. Home euthanasia without supporting medical documentation voids the guarantee.

45.7 The Buyer agrees to provide full access to all veterinary records relevant to the kitten's care, treatment, and diagnosis.

45.8 If the kitten is diagnosed with severe dysplasia within 12 months of adoption and meets all documented criteria, the Buyer may be eligible for a refund or replacement kitten, in accordance with the Genetic Health Guarantee.

    46. Medical bill policy

46.1 The Buyer is fully responsible for all veterinary bills, including routine care, emergency services, diagnostics, and treatments, unless otherwise specified in this agreement.

46.2 The Buyer may submit a claim for review if the condition is believed to fall under the Genetic Health Guarantee, accompanied by complete supporting documentation from a licensed veterinarian.

46.3 Kitten Heaven reserves the right to request a second opinion from a licensed veterinarian or specialist of the Company’s choosing before making any determinations regarding remedy eligibility.

     47. Accuracy of images

47.1 Images and colors displayed on our website are intended for illustrative purposes only and may not precisely represent the kitten’s final appearance.

47.2 Variations in coat color, pattern, or shading due to lighting, camera settings, or monitor calibration do not constitute grounds for refund, cancellation, or dispute.

    48. Sales limitations

48.1 Kitten Heaven reserves the right to limit or restrict sales to specific individuals, households, regions, or jurisdictions at its sole discretion.

48.2 We may limit the number of kittens sold to a single customer or household.

48.3 We reserve the right to modify, pause, or discontinue offerings at any time, without prior notice.

48.4 All offers are void where prohibited by law, including jurisdictions that do not permit the sale or transport of live animals.

   49. Refunds for shipping delays

49.1 The Buyer may request a full refund only if delivery exceeds 90 calendar days beyond the originally scheduled date, and the delay is due to factors within Kitten Heaven's control, excluding Buyer inaction.

49.2 If the Buyer fails to respond or arrange pickup or delivery within 14 calendar days after the kitten is declared ready, the reservation will be considered abandoned, and no refund will be issued for the reservation fee, adoption fee, delivery costs, or administrative fees.

49.3 Kitten Heaven will make all reasonable efforts to communicate with the Buyer during the coordination period. Lack of Buyer response or cooperation does not constitute grounds for refund.

    50. Refund & dispute exclusions

50.1 Refunds will not be granted for treatable conditions, minor health fluctuations, or delays caused by veterinary recovery, travel logistics, or weather-related events.

50.2 The Buyer agrees not to initiate chargebacks, payment reversals, or disputes for circumstances that are explicitly excluded from refund eligibility under these Terms and Conditions.

50.3 Any unauthorized chargeback may be treated as fraudulent activity, and Kitten Heaven reserves the right to pursue legal action to recover financial losses, including fees and damages.

    51. Add-on policies

51.1 All add-on purchases are final and non-refundable, regardless of whether they are used, fulfilled, or exercised at the time of adoption.

51.2 Add-ons include, but are not limited to:
– Delivery upgrades
– Extended health guarantees
  – Pedigree documentation
– Early spay/neuter
– Breeding rights
– FIP Protection Plan
– HCM genetic testing
– Any personalized or custom service requested by the Buyer

51.3 These add-on services are billed separately from the kitten’s base adoption price and are not eligible for refund, credit, transfer, or future reapplication under any circumstances.

51.4 The Buyer acknowledges that some add-ons, such as genetic testing, health plans, or breeding rights, may require additional documentation or approvals and are governed by the terms of their respective agreements.

51.5 Transferability and Non-Refundable Add-Ons (in Cases of Unfit-for-Purchase Kittens) In the event a kitten is deemed unfit for purchase due to a congenital or hereditary defect and a replacement kitten is offered, any add-ons such as extended genetic health insurance, the FIP Protection Plan, or breeding rights may be transferred to the replacement kitten at Kitten Heaven discretion. However, any services or procedures that have already been performed on the original kitten — including but not limited to health testing, fecal analysis, PCR testing, microchipping, early spay/neuter, or other veterinary care — are considered fulfilled and are strictly non-refundable and non-transferable.

    52. Client response timeline

52.1 Once the Buyer is notified that the kitten is ready for delivery or pickup, the Buyer must respond and finalize arrangements within 7 calendar days of the notification.

52.2 Failure to respond within 14 calendar days will result in the reservation being considered abandoned, and all fees paid — including the reservation fee, adoption fee, delivery fees, and any add-ons — will be forfeited in full.

52.3 In such cases, Kitten Heaven reserves the right to cancel the reservation and rehome the kitten without further obligation to the Buyer.

52.4 This policy ensures that each kitten is placed in a timely and responsible manner and that delays do not impact the kitten’s development, health, or readiness for transition.

    53. Website errors & accuracy disclaimer

53.1 Kitten Heaven is not responsible for typographical, pricing, photographic, or technical errors that may appear on the Website or in marketing materials.

53.2 We reserve the right to correct any errors, omissions, or inaccuracies at any time — including after an order has been submitted — and to cancel or revise orders affected by such errors.

53.3 The Buyer agrees to review all order details carefully prior to confirmation and understands that any updates to pricing, availability, or descriptions may occur without prior notice.

    54. Prohibited use

54.1 The Buyer may not use our website or services for any purpose that is unlawful or prohibited by these Terms, including but not limited to:

54.1.1 Engaging in illegal activities or promoting unlawful behavior
54.1.2 Soliciting others to participate in unlawful acts
54.1.3 Violating any international, federal, state, or local laws or regulations
54.1.4 Committing acts of defamation, abuse, harassment, or hate speech
54.1.5 Transmitting malware, viruses, or any malicious code
54.1.6 Spamming, phishing, scraping, or data mining
54.1.7 Interfering with or circumventing the website’s security features or operational integrity

54.2 Kitten Heaven reserves the right to terminate access immediately for any activity deemed harmful, abusive, illegal, or in violation of these Terms.

    55. Optional tools & third-party integrations

55.1 Any third-party tools, services, or integrations provided through the Website are offered strictly “as is” and without any warranties or guarantees, express or implied.

55.2 Kitten Heaven is not responsible for the functionality, availability, accuracy, or performance of any third-party service, including but not limited to payment processors, communication platforms, shipping providers, or embedded applications.

55.3 The use of such services is at the Buyer’s own discretion and risk. Kitten Heaven assumes no liability for losses, delays, or damages arising from third-party platforms.

55.4 All future tools, features, or updates introduced on the Website will be governed by these Terms and Conditions unless otherwise stated.

   56. Feedback, user submissions & media consent

56.1 By submitting feedback, testimonials, suggestions, or content to Kitten Heaven, the Buyer grants the Company a non-exclusive, royalty-free, perpetual, and irrevocable license to use, publish, and adapt such content in any medium for marketing, educational, or operational purposes.

56.2 The Buyer further grants consent for any photos or videos taken during the kitten’s pickup or delivery — including but not limited to pickup, delivery, updates provided by the breeder, or submitted by the Buyer — to be used by the Company for promotional use across its website, social media, and marketing channels.

56.3 The Buyer acknowledges that no compensation, credit, or approval is required for the use of submitted or captured content unless otherwise agreed in writing.

56.4 The Buyer agrees not to submit or share any content that is unlawful, offensive, defamatory, harmful, infringing, or misleading. we reserves the right to remove or disregard such content at its sole discretion.

    57. Copyright infringement claims

57.1 If you believe that any content on the website infringes upon your intellectual property rights, please contact us promptly.

57.2 Your notice must include:
– A detailed description of the alleged infringement
– The exact URL or location of the infringing content
– Proof of ownership of the copyrighted material
– Your full legal name, contact information, and a signed statement confirming the accuracy of the claim

57.3 Kitten Heaven Cattery will investigate all copyright-related claims in good faith and make every effort to respond within 30 business days of receiving a complete and valid notice.
